Debt counseling goes through a number of phases. Before the start of the debt counseling or debt rescheduling process, your situation will already be examined.

  • We will check whether you are eligible for debt assistance or debt assistance rescheduling.
Can your debts be paid off in a reasonable manner within 36 months (or 3 years)? Then you are not eligible for a debt assistance program. You can pay off your debts for 100% within a reasonable period of time. *
  • It will be checked whether your debts are settled by an amicable process (out of court) or by a legal process (with the intervention of the court).
  • The debt counselor (someone who helps you, supports you and ensures that you comply with the rules) checks whether the creditors agree to a possible debt assistance or debt restructuring process.

Can a process be started?

Then first your 'Amount to be released' (Vtlb) is determined. You will be left with this amount as a 'savings bank' to pay for daily groceries and fixed costs. You then live on social assistance level. How high this amount is depends on your personal situation.

Your income that exceeds the amount to be released (Vtlb) is saved by the debt counselor for 36 months (3 years). The amount saved is divided among the creditors after 36 months (or 3 years).

The amount saved may not be enough to pay off all debt. That is why creditors must first agree to the proposal for the debt counseling process before this process actually starts.

Do creditors accept the proposed amount and agree to the proposal? Then after the 36-month (3-year) process, the rest of your debts will be canceled.

At the end of the process, if you have successfully completed the 36 months, the debt counselor pays the saved amount to the creditors. After this period you no longer have a so-called 'outstanding debt'. Provided, of course, you do not incur any new debts.

Debt can be very problematic. Creditors send reminders, there is a bailiff at the door or you may be evicted. In that case, debt counseling or debt restructuring is a possible solution.

In debt counseling, income, expenses and debts are managed by a debt counselor. The goal is to pay off debts as quickly as possible. First, an overview is made of income and expenditure. A budget is then drawn up that is used as living money. The amount that remains is paid monthly by the debt counselor to the creditors. This process can take up to three years, depending on the level of the budget and the debts. The debt is paid off 100%.

Is 100% repayment within three years not possible? Then debt restructuring offers a solution. In debt rescheduling you will have to deal with a Released Amount (VTLB). This is a legally determined amount that you keep as a 'piggy bank' to pay for daily shopping and fixed costs. You then live on welfare level. The debt rescheduler has calculated that it is impossible for you to pay off all debts in 3 years. He/she therefore makes agreements with the creditors about the amount to be paid and makes a proposal to pay off the debts in three years against final discharge. This process may take a maximum of 36 months (or 3 years). After 3 years, the remainder of the debts are forgiven.

At the Humentum Foundation there are sufficient Budget coaches who support you in the debt relief or debt rescheduling process. For example, by jointly investigating whether expenses can be reduced.

Mind you, the Budget coaches are not debt counselors or debt reschedulers.
